COVID MASK RULING HAS TAIL WAGGING DOG

The first covid mask I saw wasn’t for covid.

It was for cancer in a chemo waiting room, on a patient with a low immune system.

First it was the mask, then the warning about wearing fragrances. Why?

Then I found out why.

Haven’t we found out more than we want to know about covid already?

Masks help cut the covid transmission rate. We’ve all seen the spray between two people without masks, with one mask, and finally two masks?

Do we need review so soon?

It’s hard thinking that so many people were so over-taxed by wearing a mask that they took them off at the first word from a Florida judge.

Thank you Florida for finding time between book banning and CRT investigations to spew your special bile on the rest of us.

What was the deciding factor from this legal genius?

U.S. District Judge Kathryn Kimball Mizelle struck down the federal mask mandate for airplanes and other modes of public transportation Monday, writing in a 59-page ruling that the CDC had exceeded its authority and failed to follow proper rulemaking procedures.

In her ruling, Mizelle argued that the mandate violates the Administrative Procedure Act, as the agency failed to prove its decision regarding implementing the mandate.

Imagine a Trump appointed judge ruling against anything that failed to follow proper rule making procedures.

How does that play at Lakeland Christian School and Covenant College. This young woman clerked for Judge Clarence Thomas as recently as 2019.

And she all about ‘The Rules.’

Will Good Sense Prevail This Time?

Grandstanding judges and politicians ought to be considered for what they are: Grandstanders.

Instead of a reasonable and measured response to covid mask wearing, we get a grandstanding judge scoring points for her special audience of supporters.

Before the Justice Department’s announcement Tuesday, White House press secretary Jen Psaki expressed frustration with the court’s ruling.

“Public health decisions shouldn’t be made by the courts. They should be made by public health experts,” Psaki said.

A Florida judge fingered by Trump for a lifetime appointment is not a public health expert.

In her ruling, Mizelle argued that the 1944 statute that gives the federal government authority to combat communicable disease as part of “sanitation” efforts was being misapplied because sanitation solely referred to “measures that clean something” and masks do not clean anything in that regard. She also argued that travelers were being restricted from the freedom to travel based on an arbitrary condition, and that longstanding case law surrounding the right to enforce “detention and quarantine” by the government was applicable only to those who were actually sick.

Talk The Covid Mask Out

This will be good conversation fodder with nurses who’ve had it with preventable illness patients?

Would it be too low to ask the Florida judge about veterinary paste, bright lights, and other ‘medical remedies’ to cure covid? Science has already spoken: They don’t cure covid.

If it’s possible to avoid covid, long covid, short covid, no symptoms covid, or anything covid related, why not work with it.

Before taking advice from a judge deemed “Not Qualified” by the American Bar Association, ask yourself this: Am I qualified to decide whether or not America should wear covid masks on planes and in terminals?

Why listen to another goofy character from the Trump tree of law?

Yes, the Florida judge is in the Federalist Society.

Is that a good thing?

In January 2021, some members of the Federalist Society, such as Jeffrey A. Rosen, argued that members who assisted Trump in the spreading of false claims of election fraud during the 2020 U.S. presidential election should be “distanced from the conservative group.” Specific members mentioned for possible removal include John C. Eastman, chair of the Federalist Society’s federalism and separation of powers practice group, who made claims about election fraud at a Trump rally on January 6, 2021 – the day of the storming of the United States Capitol. Others mentioned include Texas Senator Ted Cruz and Missouri Senator Josh Hawley, who voted against the certification of election results.
